1. Acceptance

By creating an account or using Kagliostro Cloud (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Kagliostro Cloud is a security platform that scans, monitors, and helps remediate vulnerabilities across assets you own or are authorized to test. The Service is provided on a usage-based subscription with free, paid, and enterprise tiers.

3. Your account

You are responsible for the security of your credentials and all activity under your account. You must be at least 18 years old and have legal authority to enter into this agreement on behalf of your organization.

4. Authorized targets only

You may only scan assets you own or are explicitly authorized to test. Scanning third-party assets without permission is prohibited and may constitute a crime. We reserve the right to suspend accounts engaging in abusive activity and to report violations to authorities.

5. Acceptable use

You may not use the Service to (a) attack assets without authorization, (b) reverse-engineer the platform, (c) attempt to extract data of other customers, (d) circumvent rate limits, or (e) violate any applicable law.

6. Fees and credits

Paid plans are billed monthly or annually. Credits are consumed by scans, fixes, and AI workloads at the rates published on the Pricing page. Unused credits do not roll over beyond one billing period unless stated otherwise.

7. Service level

We target 99.9% monthly uptime on paid plans. Refunds are issued pro-rata for confirmed outages exceeding the SLA. Status: status.kagliostro.io.

8. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend immediately for material breach. Customer data is retained for 30 days after termination, then permanently deleted (unless legally required to retain).

9. Warranty and liability

The Service is provided "as is". To the maximum extent permitted by law, our aggregate liability is limited to the fees paid in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved in the courts of Wilmington, Delaware.
